1. Introduction

Welcome to BigMilk ("we", "us", "our", or the "Platform").BigMilk is an online advertising platform that allows adult service providers ("Escorts") to advertise their services to potential clients ("Users").

By accessing or using our Platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our Platform.

This Platform is operated by Lusto (ABN: 88 382 970 035).

2. Eligibility

To use this Platform, you must:

  • Be at least 18 years of age
  • Be a resident of or legally permitted to work in New South Wales (NSW), Victoria (VIC), Queensland (QLD), Australian Capital Territory (ACT), Northern Territory (NT), or Tasmania (TAS), Australia
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under applicable laws

By using this Platform, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

Escorts wishing to advertise on the Platform must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access to your account

4. Permitted Use

This Platform is strictly an advertising service. We provide a venue for Escorts to advertise their lawful adult services and for Users to find such advertisements.

We do not:

  • Facilitate, arrange, or broker any transactions between Escorts and Users
  • Provide any escort services ourselves
  • Employ, manage, or supervise any Escorts
  • Guarantee the accuracy of any advertisement or profile
  • Vet, verify, or endorse any Escort or their services

5. Prohibited Content and Conduct

You must not use the Platform for any unlawful purpose. Specifically, you must not post, upload, or transmit any content that:

  • Involves, depicts, or relates to minors in any way
  • Promotes or facilitates human trafficking or exploitation
  • Advertises illegal activities or services
  • Contains non-consensual intimate images
  • Infringes on intellectual property rights of others
  • Is fraudulent, deceptive, or misleading
  • Contains malware, viruses, or harmful code
  • Harasses, threatens, or defames any person

We reserve the right to remove any content and suspend or terminate any account that violates these terms, without notice or refund.

6. Founding Member Program

Founding Member status is a special tier offered at our discretion to early adopters of the Platform. This status provides enhanced benefits including free daily boosts (compared to weekly for standard users) and other premium features.

Maintaining Founding Member Status:

  • Founding Member status requires an active listing on the Platform
  • If you deactivate your listing, you will have 30 days to reactivate it before losing your Founding Member status
  • If you registered but never activated a listing, you will have 7 days from account creation to activate your first listing
  • Reactivating your listing within the grace period preserves your Founding Member status
  • Once Founding Member status is lost due to inactivity, it cannot be restored

We reserve the right to modify, suspend, or terminate the Founding Member program at any time, with or without notice. Founding Member status does not constitute a contractual right and is provided as a benefit at our sole discretion.

7. Payment Terms

Escorts may purchase boosts to promote their profiles to the top of search results. All payments are processed securely through Stripe. We accept credit and debit cards.

No Refunds: All purchases are final and non-refundable. Purchased boosts cannot be exchanged for cash or transferred to another account. By making a purchase, you acknowledge and agree to this no-refund policy.

We reserve the right to modify pricing at any time. Any price changes will not affect boosts already purchased.

8. Content Ownership and License

You retain ownership of all content you submit to the Platform, including photos, videos, and text descriptions.

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform. This license ends when you delete your content or account, except where your content has been shared or cached.

You represent and warrant that you own or have the necessary rights to all content you submit and that such content does not infringe on any third party's rights.

9. Content Moderation

We reserve the right, but are not obligated, to:

  • Review, monitor, and moderate all content on the Platform
  • Remove or refuse to publish any content at our sole discretion
  • Suspend or terminate accounts that violate these terms
  • Cooperate with law enforcement investigations

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not:

  • Verify the identity, age, or legal status of any Escort
  • Guarantee the accuracy of any profile or advertisement
  • Endorse, recommend, or vouch for any Escort or their services
  • Accept responsibility for any interactions between Users and Escorts

You use this Platform and engage with Escorts entirely at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.

Our total liability for any claims arising under these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lusto, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms of Service
  • Your violation of any applicable laws
  • Any content you submit to the Platform

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use the Platform ceases immediately
  • Any unused purchased boosts will be forfeited without refund
  • We may delete your account and all associated data

You may terminate your account at any time by contacting us. The no-refund policy applies to any remaining purchased boosts.

14. Governing Law

These Terms of Service are governed by the laws of Australia. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in the relevant state or territory (NSW, VIC, QLD, ACT, NT, or TAS) where the dispute originated.

15. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on the Platform and updating the "Last updated" date.

Your continued use of the Platform after changes are posted constitutes your acceptance of the modified terms.
